Facts Found

Before the start of Race 7, 420 GBR 52069 was sailing on starboard and Spitfire GBR 109 was sailing on port in the pre-start area.  GBR 52069 was sailing slowly and GBR 109 was sailing upwind.  There was a collision between the boats and the bowsprit of Spitfire GBR 109 punctured the mainsail of GBR 52069.  There was a hole in the base of the mainsail approximately 30cm by 30cm in size.

 

GBR 52069 sailed in Races 7, 8 and 9 without repairing her sail.  Her finishing positions in those races were 5th, 16th and 5th respectively.  Prior to today’s races GBR 52069 was in 4th position (based on finishing places of 12th, 8th, 7th, 2nd, 7th and 4th).

 

Conclusion

Notwithstanding the damage to the sail, GBR 52069’s finishing position in Races 7, 8 and 9 was not made significantly worse by the physical damage to her sail. 

 

Decision

Redress denied.
